Terms & Conditions

These terms and conditions (T&Cs) apply to the purchase of a seasonal corporate hospitality package (Season Package), tickets to a single event (Casual Game) and attendance at an event hosted by the Dolphins NRL Limited ABN 28 655 649 639 (the Club). 

 

1. Prices and Payment
  • Each quote that the client confirms in writing constitutes a separate agreement between the client and the Club on the terms set out in these T&Cs (Booking). To the extent of any inconsistency between these T&Cs and the contents of any quote, these T&Cs will prevail.
  • The client must pay the Club the amount specified as the 'Total Cost’ for each Season Package and/or Casual Game (as the case may be) in the relevant quote. The Total Cost and any other payments to be made under these Conditions are inclusive of GST unless otherwise stated.
  • Payment can be made by credit or debit card by Visa, Mastercard or American Express or by direct deposit on receipt of invoice.
  • Payment is required in full at the time of booking, except for Season Packages which may be paid by instalments stipulated on the quote. If payment of an instalment is declined for any reason, the client must contact the Club immediately and arrange for payment of the relevant instalment within 5 days of the date that payment was due. If payment is not received during this time, the Club reserves the right in its absolute discretion to suspend any Season Package until payment has been received in full, and the client acknowledges and agrees that tickets to any events scheduled during the period of suspension will be forfeited.
  • No Season Package or Casual Game (as the case may be) is confirmed until full payment has been received by the Club. The Club is not required to issue tickets to any event or provide any other services (including access to the event) to the client unless and until payment for the booking has been received in full.
2. Program Changes

The Club reserves the right to alter the event program for any Season Package or Casual Game as advertised at any time without prior notice, including the date, venue, seating arrangements, audience capacity, entertainment and/or activities. Every effort will be made to offer a program of equivalent standard. If the date, time, or venue of an event is rescheduled or changed, the client’s ticket will remain valid for the rescheduled date, venue, and time (subject to any revised quote provided under paragraph 4.2).

 

3. Event Cancellations
  • By the client: Cancellation of full season packages prior to January 31, 2024, will incur an administration fee of 15% of the full price. Cancellation of full season packages after January 31, 2024, will incur a cancellation fee of 50% of the full price. Purchases of Casual Games are non-refundable and cannot be cancelled by the client after purchase. 
  • By the Club: The Club may cancel part or all of an event (in its absolute discretion) without notice, including if an event outside the Club's reasonable control occurs including fire, storm, flood, earthquake, explosion, war, invasion, rebellion, sabotage, epidemic, pandemic, government intervention, labour dispute, labour shortage, failure or delay in transportation and act or omission of any third person (including the NRL, subcontractors, customers, governments or government agencies).
  • The Club will use its best endeavours to reschedule any event that is cancelled by it for reasons outside of its reasonable control, however, the client acknowledges and agree that the price of Season Packages and Casual Games are determined by specific event dates and venues; and if the cost of the rescheduled event materially increases, the Club may at its absolute discretion provide a revised quote for the Booking, payment of which is required for the purposes of guaranteeing the client’s tickets for the rescheduled event.

4. Refunds

If the Club cancels an event at its convenience or for a reason other than those set out in paragraph 3B, subject to the client providing the original ticket(s) and proof of purchase, the client will be eligible for a refund of all or a portion of the cost of the Season Package or Casual Game that relates to the unsupplied event (the amount to be determined in the Club's absolute discretion) exclusive of delivery or mail fees and/or any processing surcharge (if applicable). The Club will be governed by Australian Consumer Law in dealing with refunds.

 

5. Lost Tickets

The Club reserves the right not to refund, exchange or substitute tickets after purchase nor replace tickets that may have been stolen, lost, or destroyed, except as required by law.

 

6. Conditions of Entry
  • It may be a condition of entry to individual events that a search of the attendee and/or their possessions will be required at the time of entry to the venue. Cameras, audio, and video recorders may not be permitted. The right is reserved to broadcast or telecast any event live or delayed. 
  •  Entry may be refused if tickets are damaged or defaced in any way. 
  •  The events and/or the venues hosting the events have prescribed minimum dress standards. 
  • Generally, dress code details will also be included on tickets and/or detailed in event confirmation letters and/or emails. The client must ensure all attendees conform to the dress code specified for the event by the Club and/or venue hosting the event, which at a minimum is smart casual (refer to individual event information for full dress code). The Club and/or the venue hosting the event reserve the right to refuse entry to any attendee who does not meet the minimum dress standards prescribed for the event.

7. Facility Sharing

  • There is to be only one contact per facility. This person will be referred to as the Facility Principal. 
  • The other parties involved who share the facility will be referred to as Facility Shareholders. 
  • The Facility Principal is responsible for information transfer to the Facility Shareholders. 
  • The benefits contained in each corporate package do not represent what each Facility Shareholder receives, but what is allocated to that particular facility. 
  • These benefits will be delivered to the Facility Principal, who is responsible for the distribution to Facility Shareholders, if applicable. 
  • The Facility Principal shall be invoiced the full amount of the corporate package.
  • The Facility Principal is responsible for the food & beverage account for each game. Only one account shall be issued per facility by the stadium caterers.
8. Advertising and Promotions

The client must not without prior written consent of the Club:

  • Use any trademark or the intellectual property owned by the Dolphins.
  • Conduct any advertising or promotion whatsoever in relation to the Facility or the Event, including without limitation, any hospitality signage or hospitality identification within our outside the facility.
  • Offer the tickets to the event for advertising or other promotional purposes (including prizes, contests, or sweepstakes)
  • Use the name of the Dolphins or any event promoted by the Dolphins that anyway connects with the Client such that implies or gives the impression that the Client or the Client’s activities are seen as endorsed by the Club or that the Client is a sponsor or in some other way connected to the Club or event.

9. Entry to Children

  • Certain events are not suitable for guests under the age of 18. Where age restrictions apply, the Club will advise of the restriction at the time of promoting the event, or in advance of the client purchasing tickets for that event. 
  • Tickets cannot be purchased for guests under the age of 18 when restrictions apply. The client will not be reimbursed for the incorrect purchase of a ticket for a minor for an event to which age restrictions apply (except with the Club's consent, which may be withheld at its sole discretion). 
  • Without limiting any other Club events, the client acknowledges and agrees that: 
    • External Box Facility and Corporate Suite Facility: There are no age restrictions for children in private outdoor corporate boxes or corporate suites, but children must be always supervised and meet the required dress code. Children aged under four (4) at the time of the game each year are entitled to enter Suncorp Stadium, at no charge; however, they must not occupy a seat.
    • For all function rooms, the client must ensure that any guest who is under 18 years of age is accompanied and always supervised by their parent or guardian and does not negatively impact the experience for other clients in the function room
10. Limitation of Liability 
If the Dolphins are unable to deliver on its representations in the Season Package or Casual Game offer, the client agrees to the fullest extent permissible by law to release the Dolphins from any liability and not to seek a refund or compensation from the Dolphins for any such inability. 

The Dolphins are required to abide by all government recommendations and restrictions imposed in relation to the management of the public health risks associated with the COVID-19 Pandemic (or any other public health incident), along with any other obligations, protocols, or restrictions. Any offers, benefits or inclusions provided to the client are subject to any government recommendations, restrictions or protocols allowing the Dolphins to deliver on its representations, both in the 2024 season and future seasons. 

11. Communications

To receive important up-to-date information throughout the season, it is highly recommended that the client provides a valid email address upon signing up. It is the responsibility of the client to notify the Dolphins Hospitality Team should a client’s contact details change. The Club holds no responsibility for a member's failure to update their personal details. Clients can update their contact details by emailing hospitality@dolphinsnrl.com.au.


12. Client Code of Conduct

The right of admission to any home stadium or event space is reserved. In particular, the Dolphins reserve the right to refuse entry to, or to remove from, any home stadium, any patrons who are drunk or disorderly or whose conduct is unlawful or offensive or who are not entitled to attend the Event.  Any person who causes a disturbance or who refuses to comply with reasonable requests from the Dolphins may be removed from the stadium.  

 

 The Dolphins reserve the right to suspend/cancel any season package or casual game without refund of any client who behaves in a manner that is deemed to be inappropriate. Hospitality clients must always remain mindful of those around them, and immediately report anything deemed to be inappropriate to Stadium or Club staff. The Dolphins have the right to decide what is inappropriate conduct at its sole discretion. The client has no right to object or appeal against any decision made by the Dolphins to suspend or cancel a season package or casual game because of acting in a manner the Dolphins consider is inappropriate. Please see item 15 for full venue T&CS as mandated by the National Rugby League. 

 

13. Use of Images

By purchasing a Season Package or Casual Game and attending an Event, the client acknowledges Patrons acknowledge that the Dolphins or the Hirer may use a person's image or likeness as part of any recording of the Event.

 

14. Privacy and Promotions 

When the client agrees to hire a hospitality facility, we ask the client to provide us with personal information. The client consent to us, our sponsors and partners using the client’s personal information to send the client marketing communications, communicate with the client about us, provide the client with details of offers that may be of interest to the client and let the client know about our policies and terms. Communications may include (but not limited to) potential pre-sale offers from Queensland Rugby League, Suncorp Stadium, Kayo Stadium and the National Rugby League. We also use the client information to respond to the client when the client contacts us. Communication may be via a range of electronic or digital formats and platforms. 

 

 We may share the client’s personal information with sponsors and partners, or with other third-party companies who help us provide and improve our services or who use advertising or related products. The types of other third parties with whom we share the client’s personal information include fulfilment partners, ticketing partners, advertising, marketing, measurement, and analytics services. The client’s personal information is provided to other third-party companies subject to strict conditions, as outlined in the Dolphins Privacy Policy and Collection Statement available on the Dolphins NRL website. 

 

 If the client would prefer not to receive marketing or promotional material, please contact the Dolphins Hospitality Team by emailing hospitality@dolphinsnrl.com.au  to have the client’s details removed from all future marketing and promotional databases. 

 

 The client’s privacy is important to the Dolphins and there are procedures in place to ensure that the client’s information remains confidential. We are mindful that the client’s personal details are private and as such we will only disclose the client’s information in accordance with the Privacy Act 1988. HubSpot and DataTalks administer the current data management system used by the Dolphins and Members acknowledge that their personal details will be available to these third parties for the purpose of administering Membership with the Dolphins NRL. 

 Any request for hospitality can only be made by the Facility Principal. If a Facility Shareholder wishes to request hospitality information, they must become a Facility Principal and the existing Facility Principal must submit written confirmation asking for the appointment of a new Facility Principal whereupon the existing Facility Principal be released. 

The client has the right at any time to refuse to receive marketing material. A copy of the Dolphins Privacy Policy explaining the way the client information is collected, held, and disclosed is available on our website or can be obtained by contacting the Dolphins Hospitality Team by emailing  hospitality@dolphinsnrl.com.au 
All clients acknowledge that they have read the Dolphins Privacy Policy available on the Dolphins website and understand how their personal information is stored, used, and disclosed. 

 

15.

Defined terms used in these Event Terms and Conditions:

  • ARLC – means the Australian Rugby League Commission;
  • Club – means any entity that operates a rugby league club that participates in any NRL competition;
  • Event – means a rugby league match ultimately under the control of the NRL or the ARLC held in any Venue and includes, for the avoidance of doubt, all matches hosted by the NRL/ARLC and those matches hosted by a Club or a State;
  • NRL – means the National Rugby League;
  • Patron – means any person who, at any time holds, purchases, or otherwise acquires a ticket, pass, credential, or other authorisation sold or granted by the NRL, the ARLC, a Club, a State, a Venue, or a ticketing agent (each an Organiser) allowing entry to an Event;
  • Spectator Code of Conduct – means the Spectator Code of Conduct, as amended from time to time (viewable at https://www.nrl.com/tickets/nrl-spectator-code-of-conduct/);
  • State – means New South Wales Rugby League and Queensland Rugby League;
  • Venue – means any stadium, ground, oval, park or such like term where Events are held.

 

As a Patron at an Event, you are subject to:

  • these Event Terms and Conditions, as amended from time to time;
  • the NRL’s Event Terms and Conditions (available at https://www.nrl.com/tickets/event-terms-and-conditions/), as amended by the NRL from time to time;
  • the Spectator Code of Conduct, as amended by the NRL from time to time;
  • any conditions of entry of the relevant Venue;
  • the ticketing agent's conditions of sale; and
  • any reasonable directions issued by an Organiser, which includes the representatives of each, (collectively, the Event Rules).

 

The Club may amend these Event Terms and Conditions from time to time, where a change is necessary to ensure compliance with changes in applicable laws and/or may be necessary for the best interests of the game of rugby league. By entering an Event, Patrons accept and understand as binding the Event It is each Patron's responsibility to inform him or herself of all of the Event Rules.

 

Any Patron in breach of any Event Rules may:

  • be refused entry to the Venue without any refund or compensation of any kind;
  • be ejected from the Venue without refund or compensation of any kind;
  • have his or her ticket, or such other mechanism granting access (Ticket), confiscated and/or cancelled, and have any other tickets he or she may have for future Events cancelled without refund or compensation of any kind;
  • have sanctions imposed against them by the NRL, ARLC or the Club including, but not limited to, being banned, prohibited, or disqualified from purchasing Tickets for, or attending any Event or other function played, promoted, or conducted under the auspices of the NRL, the ARLC or any Club or State;
  • be subject to legal action in connection with any contravention (including criminal prosecution); or
  • be otherwise liable at law.
Entry to the Event requires the presentation of a valid An Organiser may direct any Patron at any time to produce a valid Ticket. Each Patron must keep his or her Ticket safe and in good condition at all times.

 

At an Event, Patrons must not, without the prior written consent of an Organiser:

  • use foul, indecent, obscene, threatening, insulting or abusive words or language, or make racial or threatening remarks or gestures, or behave in a manner which is abusive, riotous, indecent or insulting;
  • disrupt, interrupt, or behave in a manner that may disrupt, an Event or other activity at the Venue;
  • enter the Venue or the playing area without proper authorisation;
  • engage in conduct that might corrupt a betting outcome of a betting event or contingency;
  • post, stick, or place any poster, placard, bill, banner, print, paper, or any advertising material on any building, structure, fence, tree, pole, cordon, or barrier;
  • distribute any printed or visual material;
  • promote any advertising or promotional material, samples of goods or services, or any other matter or thing, or otherwise engage in ambush marketing;
  • distribute, hawk, sell, offer, or expose for sale any good or services, or collect money or orders from Patrons for good or services;
  • sell, offer, or make available for sale, or give away and Ticket;
  • conduct public surveys or opinion polls, solicit money, donations or subscriptions from members of the public;
  • misuse, deface, damage, or tamper with any building or thing;
  • block any thoroughfare;
  • litter;
  • throw or kick any stone, bottle, or projectile;
  • disrupt, interrupt, or behave in any manner that may disrupt or interrupt any official, employee, or contractor of the Organisers, any match, or any activity associated with the Event;
  • act or conduct oneself in such a way as to hinder, obstruct, or interfere with any participant, or to adversely affect the safety of the public;
  • deliberately obstruct the view of any Patron seated in a seat in the immediate vicinity, or cause unreasonable inconvenience to any Patron, official, or employee, or contractor of an Organiser, or interfere with the comfort of any Patron and their enjoyment of the Event;
  • interfere with, obstruct, or hinder each of the Organiser's representatives in the exercise of his or her powers, functions, and duties;
  • operate or use a loud hailer, public address system, or other device which may interfere with electronic or radio equipment operated by or on behalf of the Organisers;
  • ignite any flare or firework, or operate any laser pointer or distress signal;
  • busk or conduct similar entertainment;
  • become intoxicated or use illicit substances;
  • supply alcohol to minors;
  • smoke, except where the Venue has a designated smoking area;
  • fail to comply with the Event Rules or any lawful request of the Organisers or the Police.

 A Patron must not, without the prior written consent of an Organiser, have in their possession at an Event, or bring into an Event any:

  • alcoholic beverage (unless purchased at the Event);
  • glass bottle, glass container, or can (unless purchased at the Event);
  • beverage container with manufacturer's seal broken (unless purchased at the Event);
  • eskies and bags of dimensions greater than 35cm in height, 20cm in width and 30cm in length, or too large to be stored underneath a seat;
  • clothing bearing any racist, indecent, indecent, or obscene language or images;
  • clothing bearing any unauthorised commercial, political, or religious language or images;
  • illicit drugs;
  • spray paint;
  • prohibited or controlled weapon, firearm, or any dangerous goods, including without limitation knives and other dangerous weapons;
  • animal (other than an assistance dog);
  • metal flag or banner pole longer (or extending to longer) than 14 metres in length, or any flag or banner which could reasonably be in contravention of 6(q) above;
  • whistle, loudhailer, horn, bugle, or other musical instrument;
  • flare, firework, laser pointer, or distress signal;
  • public address system, electronic equipment, broadcast equipment or similar device which may interfere with broadcast equipment or similar device being used by the NRL or other persons authorised by the NRL in connection with the Event;
  • vehicle including bicycle, skateboard, roller skates, roller blades, or scooter;
  • item that the possession of which does not have an ordinary and reasonable use by a Patron at the Event and which may cause injury or public nuisance;
  • item in such quantities that a reasonable person could infer that the item is to be used for commercial purposes;
  • goods or Tickets for the purpose of sale or commercial distribution;
  • camera lenses with a physical length greater than 200mm or any other item which might reasonably obstruct the view of other Patrons;other items as determined by the Organisers or the Police from time to time.

Any consent to any item brought into an Event given by an Organiser may be revoked by any of the Organisers at any If such consent is withdrawn, the Patron must immediately relinquish the prohibited item to the Organisers or leave the Event immediately.

Patrons acknowledge that the NRL may use any personal information received by the NRL from the other Organisers in accordance with the NRL Privacy Policy (available at https://www.nrl.com/privacy-policy/) which details how the NRL uses and discloses personal information, how Patrons can access and/or correct their personal information, and how a Patron can make a complaint about the NRL's use or disclosure of personal information.

 Patrons are advised, in accordance with applicable State and Commonwealth privacy legislation, that the relevant State or Federal Police may provide each of the Organisers with the name, address, date of birth and photograph of any person detained or arrested by Police at the Venue and the nature of any action or criminal proceeding initiated by Police as a consequence so that each of the Organisers can consider, and if deemed necessary, implement a ban on the person from attending future Events.
